1. THE PROMOTER
The Promoter is: SAZERAC UK LIMITED of 174 Terrace Road, Walton-On-Thames, Surrey, England, KT12 2ED trading as HI-SPIRITS LIMITED (“Hi-Spirits”).
2. THE COMPETITION
2.1 The title of the competition is [The Spirit of New Orleans Venue Incentive.
2.2 The winner of the competition will be the consumer-facing venue in the UK that is licensed to sell alcohol on the premises (“Venue“) that sells the most South Comfort Black and/or Original (in the aggregate) in the Sales Period (defined in 3.3). The final sales results will be calculated based upon a Venue-by-Venue calculation derived from each participating Venue’s total case volume sold at the relevant Venue divided by its authorised capacity (“Sales Results”).
3. HOW TO ENTER
3.1 The sign up period for Venues to enter the competition will run from [12:00am] on the [1/09/18] to the [11.59pm] on 28th October 2018 (“Sign-Up Period”).
3.2 The sign up process for a Venue to enter the competition is for any employee of a Venue or the account manager of a Venue (together “Venue Team Members”) to notify the Hi-Spirits’ sales representative for that Venue via email, phone, or in person that they would like their Venue to participate in the competition.
3.3 Venue Sales Results will be tracked by the account manager of the competing Venue from [12:00am] on 29th October 2018 (the “Opening Date”) to [11.59pm] on 25th November 2018 (the “Closing Date”) inclusive (“Sales Period”).
3.4 All Sales Results must be submitted by the account manager of each Venue that has signed up to take part in the competition to the relevant sale representative at by no later than [11.59pm] the 2nd December 2018.
3.5 Sales Results are to be communicated to the Hi-Spirits sale’s representatives for each Venue who will then relay these figures to the Promoter through the Promoter Brand Manager Toni Law toni@staging.hi-spirits.com.
3.6 By submitting a competition entry, the Venue and the employees of the Venue agree to be bound by these terms and conditions.

4. ELIGIBILITY
4.1 The competition is only open to all Venues in the UK that stock and serve Southern Comfort Black and Original and that have a valid alcohol license.
4.2 In entering the competition, the Venue confirms that all Venue Team Members are at least 18 years of age. Venue agrees to comply with all applicable law including UK licensing and employment laws.
4.3 The Promoter reserves the right to disqualify a Venue if their conduct is in the opinion of the Promoter contrary to good business practice, good faith or otherwise may bring the reputation of Promoter or its products into disrepute.
5. THE PRIZE
5.1 The first prize is a return trip to New Orleans from London for himself/herself and a guest (‘Winner Prize’).
5.2 The next four runners-up will win £500 to be spent on an evening out (including food and entrainment) organized and accompanied by the Hi–Spirits sale’s representative for that Venue (‘Runners-Up Prize’).
5.3 The Promoter reserves the right to replace the prize(s) with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
5.4 The prize is not negotiable.
5.5 The prizes are awarded to the Venues as a whole. The account manager of the Venue is the individual who will be notified as to the Winner Prize and the Runners-Up Prize respectively in the first instance, and the account manager will be free to allocate this prize to any Venue Team Member of the relevant Venue.
5.6 The individual and guest that will claim the Winner Prize and the individuals who will claim the Runners-Up Prizes on behalf of the Venue will be confirmed by the account manager of the winning Venue within [2 months] from the Announcement Date to both the individual winners themselves and the Hi-Spirits’ sales representative identified in paragraph 5.7.
5.7 The names of the individuals to receive the Winner Prize and Runner- Up Prize will by communicated to the Promoter through Toni Law (Brand manager of Hi-Spirits) by the Hi-Spirits’ sales representative of the winning Venue.
6. WINNER ANNOUNCEMENT
6.1 The winning Venues of the competition will be announced to the winner Venues and may also be featured on the Promoters website (https://staging.hi-spirits.com/ on or as soon as practicable after 14 December 2018 (Announcement Date).
6.2 The decision of the Promoter is final and no correspondence or discussion will be entered into.
7. CLAIMING THE PRIZE
7.1 Once the individual winner of the Winner Prize and their guest are finalised in accordance with 5.5, 5.6 and 5.7, the Promoter will contact the individual winner and collect the personal details necessary to make the flight and accommodation bookings for the trip to New Orleans (personal information that maybe requested includes but is not limited to first and last names, passport numbers, dietary requirements, age, residential address, nationality, disabilities). This personal information will not be stored longer than necessary to make the relevant bookings and then will be deleted from the Promoters systems.
7.2 The winners of the Runners-Up Prize will receive communication from the Hi-Spirits’ sales representative regarding details of their prize within [1 month] from the Announcement Date.
7.3 The Promoter will make all reasonable efforts to contact the individual winner of the Winner Prize and Runners-Up Prize. If the individual winner cannot be contacted or is not available,or has not claimed their prize within [2 months] of days of the Announcement Date, the Promoter reserves the right to offer the prize either to another of the winning Venue’s Venue Team Members or to another Venue that entered the competition.
7.4 The Promoter does not accept any responsibility if the relevant Venue Team Member is not able to take up the prize.
8. DISCLAIMER AND LIMITATION OF LIABILITY
8.1 Save only for personal injury or death arising from the negligence of Promoter or its employees, Promoter shall not in any circumstances be liable to any Venue or any Venue Team Member in connection with this competition for any loss (whether direct, indirect, incidental, special or consequential) whether for breach of contract, tort (including negligence or breach of statutory duty), or under any other theory of liability.
8.2 The individual winning Venues, and in first instance the relevant Venues’ account managers, are solely responsible for determining which of the Venue Team Members will be awarded the Winner Prize and Runners-Up Prizes, and in doing so the Venue will comply with all applicable law, including UK employment law. Once the individual recipients are decided and communicated to the Hi-Spirits sales representative for that Venue, the decision will be final. Any complaints as to which Venue Team Members is awarded the Winner Prize and Runners-Up Prizes must be directed to the account manager for the Venue. All participating Venues agree to indemnify Promoter against any loss or liability suffered by Promoter in connection with a claim by any Venue Team Member in connection with this competition.
9. DATA PROTECTION AND PUBLICITY
The Promoter will only process any personal information collected as set out in the [https://staging.hi-spirits.com/privacy-policy/]
10. GENERAL
10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude a Venue from participating in the competition.
10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
